By using PergAI services, you agree to the following terms of use. These terms constitute a legal agreement between you and PergAI. Please read this text carefully.

1. Service Description and Registration

PergAI is a SaaS (Software as a Service) platform that allows users to edit product photos and create new visuals using artificial intelligence technologies. To benefit from the service, you must register with a valid email address and ensure your account security. You are responsible for all activities occurring under your account.

2. Financial Transactions and Lemon Squeezy

All financial transactions, billing, and subscription management on PergAI are handled by Lemon Squeezy (Merchant of Record). By purchasing credits or subscriptions, you also agree to Lemon Squeezy's terms of sale. Taxes and local legal compliance are the responsibility of Lemon Squeezy.

3. Content Responsibility and Usage Rights

The legal ownership and responsibility for all original images you upload to the platform belong to you. PergAI grants commercial usage rights for the generated images to the user as long as the relevant fee is paid. However, the user undertakes not to generate content that is illegal, obscene, threatening, copyright-infringing, or violates the rights of third parties. PergAI reserves the right to delete content and suspend accounts that do not comply with these rules.

4. Credit System and Expenditures

Purchased credits act as digital tokens for transactions within the platform. Transactions initiated by artificial intelligence models (image generation, background removal, etc.) are irreversible and spent credits are non-refundable. Credit refunds for transactions that cannot be completed due to a technical failure are subject to customer support review.

5. Disclaimer of Warranties

The service is provided "AS IS" and "AS AVAILABLE". PergAI makes no warranties, express or implied, regarding the quality, accuracy, continuity, or fitness for a particular purpose of the generated images. Due to the nature of AI technology, results may vary.

6. Limitation of Liability

To the maximum extent permitted by law, PergAI shall not be liable for any indirect, incidental, or punitive damages, including loss of profit, loss of data, or business interruption arising from the use of the platform, even if notified of the possibility of such damages. In any case, PergAI's total liability shall not exceed the amount paid by the user to the platform in the last 6 months.

7. Indemnification

The user agrees to indemnify and hold PergAI and its affiliates harmless from any claims, damages, and costs, including attorney's fees, arising from their use of the platform, violation of these terms, or violation of any third party's rights.

8. Modifications to Service and Terms

PergAI reserves the right to update service features, pricing, or these terms of use without prior notice. Changes are effective as soon as they are published.
